Baseball Dad: Will I Be Arrested if I Watch My Son Play?

Scott Dean, banned from PTWLL, begs Town Council for its help in resolving the situation.

 

The Parsippany Town Council last week advised a local man that the  Par-Troy West Little League has the right to ban him from the land it rents from the township.

That view was backed by Mayor James Barberio.

For Scott Dean, the father not allowed to watch his young son play baseball, that answer was not sufficient. He appeared again before the council at its Tuesday night meeting at Town Hall to plead his case in hopes that the body would change its mind and issue a directive forcing the league to allow him access to see his child in action.

Dean referred to portions of the township's lease with PTWLL.

"There is nothing specific that empowers them to not allow me to watch my son play baseball on town-owned public property," he said. "In fact, the lease states the Par-Troy West Little League shall comply with all directives, laws and ordinances set forth by this municipality."

Last week, the council and the mayor said authority rested with the national Little League organization.

"Little League International says that this is absolutely a local issue, so with your comments last week and their comments, nobody controls Par-Troy West Little League," Dean stated. "They have the power to make decisions with or without cause, with no accountability to anybody, [while] using property of the town.

"That being the case, will the council and you, Mr. Mayor, be directing the Parsippany Police Department to have me removed if I do happen to go down to watch my son play on the public property?"

Township Attorney John Inglesino told Dean that the matter was not an appropriate one for the governing body.

"It's an issue between you and Par-Troy Little League West," he said. "It's not an issue for the Township Council because it is not a township league. ... Your issue does not relate to the township property. It relates to the way in which the league is treating you."

The attorney added that there is no mechanism for the Town Council to inject itself into the dispute between Dean and the PTWLL, even if the members wanted to do so.

"I'm actually begging, pleading with the council, as well as to [Council President Brian] Stanton, who reached out to me, to help me get a resolution to this," Dean said.

Councilman Paul Carifi Jr. asked if the police would arrest Dean.

"If Mr. Dean went to a game and stood in a corner, is the league going to call the police and have them remove him or arrest him?" he asked.

"If there is any incident that would warrant police intervention, it would not be out of the realm of possibility for the police to be called," the attorney replied.

Carifi continued.

"But what if Dean was just standing there, silently watching the game? I mean, I have young kids. I cannnot imagine not being able to watch my kids play," he said. "If he's there and not causing a problem whatsoever, they still have the right to [have him arrested]?"

"The league has the right to enforce its rights under the lease," Inglesino explained. "The property itself is being leased out to [the league]. They control the property, they control who's permitted on it. The lease ceded that right to them."

It's my understanding that if Mr. Dean just apologized to PTWLL, he would be allowed at complex. Apologizing for comments he made with no specific proof of them being true. Just apologize already and go watch your son play.

I find it extremely distressing that Mr Carifi, a member of our Town Council who has taken oath to uphold the laws of our state and municipality, would encourage someone to trespass against another whether he agrees with the reasoning behind the decision or not. Our elected are trusted with upholding the law and if one is so willing to disregard the laws in place that protect the rights of each of the citizens of his community then I give question as to what other laws he might easily set aside. A seat on our town Council does not elevate his judgement above the law and I would expect that he would stand behind our law enforcement officers if they are called upon to enforce them. If need be, we have judges that are charged with rendering decisions. I look for heart in our elected but first they have an obligation to respect the laws, and the rights given to each by law, even if he might not agree with the why. I've always had confidence that each member of our Town Council would easily meet this minimum standard but now I'm quite concerned to learn, that is not the case.

Carol M, are you basing your comments on a private conversation with Mr. Carifi? The quotes attributed to him in the article in no way suggest he endorses trespassing. He merely is asking a question to the Township lawyer looking for more information.
You seem quick to jump on Mr. Carifi where is appears to me he was doing the right thing by trying to gather more information to make an informed decision. Not a bad thing for a politician to do in my opinion.

Carol, If you would actually ATTEND a council meeting you would know what took place. Mr. Carifi asked if he would be arrested if he attended the game. He never suggested doing so - merely asked a question and FYI the Chief of Police was at the meeting too.

Carol, you are absolutley correct. Mr. Carifi should know better. Mr. Carifi knows the situation but feels that if someone breaks the Sports code of conduct it's ok! What Mr. Carifi should have done at the council meeting was ask Scott Dean what Sport Code of Conduct did you violate to get a 7 year suspension?

Mr. Carifi knows the answer to that. What Mr. Carifi should do is find out what transpired. He doesn't do that. He says, if Mr. Dean goes to the game and is not causing a problem are you going to arrest him. Well why have rules! Then we just just stand by and take Mr. Carifi's theory and let someone who broke the Sports Code of Conduct not follow the rules going forward, and then maybe something worse happens. It's funny all those that try to defend Mr. Carifi, Crawford and Michael have one thing in common. They do not like Frank Neglia. So pretty much their opinions are Bias.

I have attended many Council meetings and I see a big difference between attempting to negotiate a resolve within the law or offering to assist a community member having troubles then what Mr Carifi's questions were about which was trying to find a way around the law. What I took away from his "questions" was...hey guys, are we really going to enforce the law even if the perpetrator is all stealth about it and just kinda quietly violates the no trespass order? I expect that when our Town Council members are seated at the table, and they are representing the entire community in the decisions they are making and the questions they are asking, that they would uphold the laws that are in place to protect all our rights and not seek out a way or encourage someone to sneak around them. The Town Council has the authority to properly address any concerns they might have but they don't have the authority to wink, wink over the laws I count on to keep me feeling safe.

Carol, Having a heart is not a criminal offense neither is having common sense.
If the allegations against me can all go away with a apology doesnt seem to me like the allegations are all that provable.If so enforce my sentence after their claims come to be proven.How does anyone think that enforcing this type of punishment against a Father and Son is acceptable when all it is are accusations of their own.

Patch3, Looking at the attached documents in this article it appears Mr. Dean has appologized in writing to the PTWLL Board on March 30. If all they wanted was an appology for it to go away and as you say "just appologize", it appears he has so let him watch his son. If he steps out-of-bounds at any time while on the complex, then ban him for good.

Were a society of second chances, shouldn't Mr. Dean have one; better yet shouldn't his son.

Bob--Scott..in looking at the March 30 letter, apology is certainly there for actions taken..Point taken. If PTW has been looking for that to allow Scott back in..then he followed through on that. Now it's time for them to. I do believe in second chances--especially regarding Scott's family situation and how important spending time with his son is.

Seriously again? It's obvious the board wants an apology that what he said wasn't true which is obviously they weren't. All due respect it's clearly he is looking for a problem. Scott you and Steve Revette have been talking about the girls softball fields. You don't have a daughter what were you doing down by the fields in the first place? Sometimes when you try and ruin people's good names and reputation an apology is not good enough. Also I passed by the park road feels and there were people working on those fields all day. I'm not talking about people who work for the town but more then likely people who volunteer for little league.

Come on folks. At Tuesday's Town Council meeting,(which I attended) Councilmen Carifi and Ferrara simply offered to see if they could broker a resolution to the ongoing problem created by the PTLLW's absurd 7 year ban of a Dad who asked some questions that made certain leaders of the PTLLW uneasy. Councilman Ferrara and Counciman Carifi unlike Mayor Barberio ( who cowered behind Mr. Inglesino's opinion that this wasn't the Municipality's problem) demonstrated the feelings that parents in Parsippany share when they proudly watch their sons and daugthers participate in America's past time. Sports in Parsippany teach our children to win and lose graciously and hopefully with Mr. Carifi's and Mr. Ferrrao's help the PTHLW, which is rapidly losing the community's respect and support, will direct Mr. Neglia and his cronies to stop acting like spoiled brats and to begin acting like the boys and girls who honor the PTHLW with their sense of good sportsmanship and fair play. Enough grandstanding already. Let's play ball and invite everyone to the game that kids love even when they are all grown up.

All due respect Mr. Crawford you are acting like this guy did nothing wrong. The very people you call spoil brats are the very people who VOLUNTEER on a regular basis. These people on the board do not get paid. Bob you are taking the word of one person vs the word of 25 board members. Are you really saying all 25 board members are corrupt? Is it good sportsmanship to say you're going to take out board members? You want fair? What Scott Dean said about these people wasn't fair. Bob just wondering you live on the high side of town. Who on little league west board do you know with the exception of the neglias? I'm not talking about you know of them but you know them because you have actually had a conversation with them.

The Council and PTWLL should be applauded for their decisions and for standing up to the sordid conduct of Scott Dean.
Scott Dean EARNED the ban by engaging in a sustained campaign of bad behavior (to put it nicely).
Scott Dean is sleeping in the bed he himself made, and that is the fairest type of justice.

As for the son not having his father watch games, the son has only his father to blame for that and it ultimately may be a benefit for young man.
If the young man feels some sting now from his father's conduct, perhaps then the young man will learn that there are consequences to choices, that individual responsibility matters, and that juvenile and reckless conduct like his father's can't be rewarded.

The man with the foul lanquage is back. Mr. Crawford likes using words like cronies. Why because Mr. Crawfod doesn't like Neglia. Now all of a sudden Mr. Crawford is a Lawyer. Isn't your good friend a lawyer? The one that had to pull you away at the Parsippany High football game when you were using all that foul language. At least you finally admid it. MAYBE YOU SHOULD READ THE SPORTS CODE OF CONDUCT. Let's talk about Councilman Carifi. He should know better. I like the way he Carifi uses, oh I wouldn't want to be banned from seeing my child play. THEN DON'T BREAK THE RULES. Grandstanding, are you kidding me Mr. Bobby. That is all you do is GRANDSTAND. By the way Mr. Crawford do you know what happened at the PTLLW complex? On going problem? So what do does a youth organization do. Let volunteer coaches use foul lanquage any time they wish. Well I guess you wouldn't mind since you use foul lanquage during high school games.

Let it go and let a Dad watch his son play ball. Mistakes have been made and apologies extended. At the very least let's agree that the punishment should fit the "crime". A seven year ban for asking some questions that made some people uncomfortable.By the way would anyone from the PTTLW care to explain how that 7 year sentence was arrived at?
Come on Frank, Robert and Gordo unruffle your feathers, demonstrate your magnanimity, pull up your big boy pants and move on with the great work that the PTLLW under the leadership of the 25 member Board of Directors is doing.

Lets be clear
1)The violation of code of conduct they are reporting is threats made to board members
Absolutely false if threats were actually made their eronious police reports would have at least amounted in me being contacted by police.
2)There has never been incident or complaint made against me of inappropriate behavior around or during games,
3)What I did was actually report unsportsmanlike behavior which was asked for us as coaches to do in the start of the season,but it was one of their own so to speak and when it wasnt dealt with in a manner I thought was appropriate I went to a higher authority.which upset the league,hense coaching being revoked and the start of no questions being answered.
All we need to do is have ALL members of this board and myself sit down and hash this out as I have asked since March of last year.
Maybe one of the boardmembers can comment on police reports and or illegal backround checks and a 7 year ban also why do coaches and or parents with much more questionable behavior watch and coach while I do not.
Answer the questions Please !!!

Mr. Crawford yo still didn't answer my questions. You call these people cronies how many of them do you know? How many people on the Par Troy west board of directors do you know? Also this wasn't the first punishment handed out. It's not like they went straight to seven years. At 1 point he was banned from everything but his son's games meaning he could attend them. He kept pushing and pushing and finally the board had enough. Also to Scott. I DO AGREE WITH YOU ON 1 THING.

Gordon, I was allowed to attend only within the timeframe they gave for their apology.
Also you keep referring to 25 people on this board.Though 25 shirts were handed out doesnt mean 25 people vote nor does it mean all 25 have all the information on what transpired going back to June 2010, Why has the request of a full member sit down been rejected.
Let me be clear this is not against the board as your president keeps claiming.
Very simple: One Meeting, All Members, 1 Solution lets try it?

let the man watch his son play he has every right to ask a question if you think he is wrong just take a good look at your fields what bad shape they are in and the food stand it is sad then look at the east fields much much nicer this is what happens when you have the same people running the show look at the board all close friends husband wife husband wife and the softball director has no kids in the league same people over and over for years were is the money going for improvements

A Parent... I'm a PTWLL coach and I agree with you that the fields are in bad shape, but have YOU ever volunteered to fix them. The food stand IS sad, but again, what have YOU done about it. You don't like who's on the board? Have YOU ever tried to get on it? The softball director has no kids in the league, who cares... at least he volunteers his time. DO YOU!?!?!??!

A PARENT what's that suppose to mean he doesn't have any kids in the league? My father does a lot for those girls. All the problems they have at the baseball field they do not have the softball fields. While I'm sure there are people who dislike my father a majority of people like him. He has made a system that works and he FOUGHT for those girls to have bathrooms put in. He also voluntarily took a couple days off from work to get the field ready for Brooklawn to use because it's tough for some people walking down to that pathetic field. How can any of you accuse my father of stealing? My father is a very very good softball coach. He's gotten offers from schools all over the country to coach but he DECLINES each and every one for two reasons. 1. He only likes to volunteer. 2. He doesn't want to let the girls down. You really think he would do something like that to ruin his very well RESPECTED name from all over the state. Guys when was the last time a baseball team won district championship? Last year both the 9 10 year olds and 11 12 year old softball teams won districts with the 10 year olds going to states. In about the past 10 years softball has produced 7 district championships Baseball has produced about 1. Also you sit here and think that the season is only from April to June. There are clinics. Pitching lessons. Fall ball. A parent why don't you go and ask the softball coaches if they think my father is as evil as you make him out to be. A majority will disagree

Enough is enough. Look how much time and energy the league is wasting on this issue. Regardless of what Scott Dean did (if anything) a seven year, "you may never watch your kid play little league again" sentence is a bit harsh. A convicted sex offender is allowed on the complex grounds but a dad who has bad blood between himself and the league is forbidden. Maybe PTLLW should spend more time cleaning up the fields (excluding park road) cleaning up the complex and stop making kids begs for money doing a can shake.

You have asked me questions and I have answered them.Are you curious at all,The board as a whole has a responsability to make informed decisions on everything.They run the league together their job should be to make decisions on facts not what someone tells them to do.
Please focus on facts. you cant always believe everything you hear.

Nobody is in anybody's pocket. Like every organization I'm sure everybody has certain responsibilities. Not everybody deals with every thing. Like the safety officer will not deal directly with the umpires that is Mike Jr's job. This is all I'm saying on this matter. Par Troy west has issued their statement I' don't need to defend them anymore.

Steve, Thanks for responding, I just hope reasonable minds will prevail here.
If the entire board was a)accused of anything inproper or b)threatened in anyway as Mr.Justino claims.
Wouldnt they all be involved with clearing this matter up for the reputation of the league if anything?
My belief is that people on the board including many parents of the league dare not question things for fear of the Wrath that can obviously come.
Please ask your family and any boardmember for this final resolution
1 meeting All members and 1 solution= my dream of fields
