NJDEP Can not Be Trusted with Stormwater Wetlands Protections

 Someone should bring up improper Procedures Land Use Law 40:55D-10 Hearings. Public was disenfranchised. There is a Wetland Transition Zone on the Property, Wetlands Border the property. No proper Maps showing all this, were displayed contour, slope, borders wetlands, tree inventory and no cross examination of witness nor our witness Mr. Plambeck from the Passaic River Coalition was allowed to speak. September 9 planning board in Parsipanny, no public comment was allowed.

 Barberio has been the main promoter of this development ,as Mayor and Planning Board member; his mind was made up along with "others" already, before any findings of facts could be concluded. Without knowledge of impacts or scrutiny of NJDEP,rules and regulations, Rutgers Study, examining  the EcolScience Report submitted by the developer even adhering to the Title 40 Land Use Law principals ; especially at the Hearing process. This has to count for something... It's the Law.

News from Hamilton Township NJ. On September 9th, the New Jersey Appellate Division agreed with our arguments and struck down the NJDEP approvals for the CareOne development. The court found that the point system NJDEP uses to determine whether a proposed development effectively manages stormwater had not been properly vetted through the rulemaking process. This ruling will cause the NJDEP to take informed comments from the public if it wants to continue to rely upon its point system for considering stormwater impacts from proposed projects.

  Still working on my comments concerning Troy Brook Stormwater Water Quality, Recharge Study. Block 421 Lot 29 does not exist in vacuum. The EcoLScience Report submitted by RDR is flawed. passing off to NJDEP is not the answer.. Brown Space or Blight needs to be addressed Build more impervious space while other existing impervious space is not being used??That's not efficient land use..Town Officials whom do not realize the importance of wetlands belong not in office here in Pa-sippo-nong land of many waters. Man is not Stronger then the Storm. nor is the Developer RDR.
