Board reportedly says filing a lawsuit is the only legal means it has to satisfy the Department of Education's demand.

The Board of Education answered a Department of Education deadline by sending the state a letter dated Jan. 30, indicating that it will head to the judicial system to try to recoup the $38,000 it allegedly overpaid the superintendent under an unapproved contract, according to the Daily Record.

The school board decided to sue Seitz for the money because, according to the Daily Record, it was left with no other lawful choice. According to district Interim Business Administrator Mark Resnick, deducting the alleged overage from the superintendent's future paychecks would be illegal.

Resnick has not responded to requests for information.

BOE members say that according to statute, only the body's president may comment on the matter. Dr. Frank Calabria has not responded to Patch requests for comment. The same holds for the executive county superintendent's office; for Parsippany BOE attorney Mark Tabakin and for Seitz's attorney, Andrew Babiak of the New Jersey School Administators Association.
